Adler Modemärkte AG, Industriestrasse Ost 1-7, 63808 Haibach, Germany (hereafter “ADLER” or “we”) is responsible in terms of data protection for processing your personal data in connection with the website www.adlermode-unternehmen.com. In this context, we will process your personal data for the purposes stated in this privacy notice. 

We will only process your data in accordance with the applicable data protection requirements of the EU General Data Protection Regulation 2016/679 (“GDPR”), the German Federal Data Protection Act (“BDSG”), and other applicable data protection regulations. In doing so, we guarantee the protection of your personal data, in particular through technical and organisational security measures that comply with current security standards.

1. Access data and hosting

Access data

You can visit our website without providing any personal information. Every time you use our website, the web server automatically stores a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of use, the amount of data transferred, and the requesting provider (access data), and documents the retrieval. This access data is evaluated solely for the purposes of ensuring trouble-free operation of the website and improving our product. In accordance with Art. 6 (1) sentence 1 letter f) GDPR, this is necessary for the purpose of the legitimate interests we pursue in connection with the correct presentation of our product, which is our primary concern in the context of balancing interests. All access data are deleted seven days at the latest after your visit.

Hosting

A third party provides the services for hosting and displaying the website on our behalf. This is necessary for the purpose of the legitimate interests we pursue, which predominate in the context of balancing interests in the correct display of our offer in accordance with Art. 6 (1) sentence 1 letter f) GDPR. All data collected as part of the use of this website or in intended forms in the online shop as described below will be processed on its servers. Processing on other servers takes place only in the context explained here. The third party service provider is located within a country of the European Union or the European Economic Area.

2. Data collection and use for contact purposes

We collect personal information you voluntarily provide to us when contacting us (e.g. using a contact form or e-mail). Depending on the type of contact you make, you may be required to provide obligatory information. Which information is obligatory when making contact can depend on the reason for your contact and the method of contact you have chosen. Which information is obligatory can therefore vary. Obligatory information is marked as such and is mandatory for processing your contact, otherwise we cannot respond to your contact request.

If you have any questions about our group of companies, we will use the data you provide to process your enquiries in accordance with Art. 6 (1) sentence 1 letter f) GDPR. Data processing is based on our legitimate economic interest in acquiring new investors. If you contact us as a “Treuekarte” customer, as an online shop customer and/or as a buyer or potential buyer, data processing is based on Art. 6 (1) sentence 1 letter b) GDPR. If you contact us during an application process, the data processing may be based on § 26 (1) sentence 1 BDSG in conjunction with the provisions of the GDPR and Art. 6 (1) lit. a) and f) GDPR.

After complete completion of contact, your data will be restricted for further processing and erased at the end of the tax and commercial retention periods, unless you have expressly consented to further use of your data or we reserve the right to use more data, which is permitted by law and about which we inform you in this notice. The erasure of your data is possible at any time and can be carried out by sending a message to the contact option described under point 8.

When processing your contact enquiry, we are supported by service providers who are based within a country of the European Union or the European Economic Area and who process your data on our behalf exclusively for ADLER.

3. E-mail newsletter

If you subscribe to our ADLER-Investor-Relations-Newsletter, our ADLER E-Mail-Newsletters and/or to our ADLER E-Mail-Gruppen-Newsletter we will use the mandatory and optional data you provide to regularly send you our e-mail newsletter, based on your consent in accordance with Art. 6 (1) sentence 1 letter a) GDPR. Unsubscribing is possible at any time and can be done either by sending a message to the point of contact, described under point 8 or via a link provided for this purpose in each newsletter. When you unsubscribe, we erase your e-mail address, unless you have expressly consented to the continued use of your data or we reserve the right to the further use of your data if legally permitted and we have informed you of this in the context of this notice. Our newsletters are dispatched through a service provider.

For this purpose, we will provide your e-mail address to the service provider when you subscribe. The service provider is located within a country of the European Union or the European Economic Area.

5. Google Maps

Our corporate website uses the map service Google Maps from Google LLC. To integrate and display Google Maps on your browser when your browser queries the contact site, the website must be able to connect to a Google server, which may also be located in the United States. Google receives the information that the contact page on the website was viewed from the IP address associated with your device. In the event that personal information is transferred to the USA, Google has submitted to the EU-US Privacy Shield.

The Store Finder allows you to use location data to search for nearby ADLER branch and display them in Google Maps. You can enter address data in a search field (postal code or city and/or street name). If you only want to search for a branch nearby, you can also use the Store Finder’s automatic locate feature by clicking the “Filialen in der Nähe” button. This activates the HTML5 “Geolocation” feature for automatic location determination, which all common browsers support. Before your browser determines the location, you must explicitly allow this for privacy reasons by accepting the execution of this feature. Depending on which browser and which device you use, your IP address, received signals from WLAN networks, and – especially if you are using a mobile device – GPS, and cellular signals are used for the subsequent location determination. The address data you enter in the search field of the Store Finder or the location your browser automatically determines are transmitted to Google via an interface, so the ADLER branches found in the vicinity can be displayed in Google Maps.

In addition, you can also use Google Maps to display the location of company-relevant events, such as the exact location of the annual general meeting of Adler Modemärkte AG.

The legal basis for this data processing is Art. 6 (1) f) GDPR on the basis of our legitimate interests, in particular the provision of the Store Finder described above, the easy display of information about the venue of events relevant to the company and the optimal marketing of our website and ADLER branches.

If you visit the Google Maps service on our website while logged into your Google profile, Google may also link this visit to your Google profile. If you do not want your website visit to be associated with your Google profile, you will need to log out of Google before using our Store Finder. Our website integrates components of the service YouTube. YouTube’s operating company is YouTube LLC, located at 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube LLC is a subsidiary of Google Inc., located at 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA.

Each time you visit any of the pages on this website that incorporate a YouTube component (YouTube video), the specific YouTube component will automatically prompt the browser on your device to download a representation of the corresponding YouTube component from YouTube. As part of this technical process, YouTube and Google are aware of the specific subpages of our website that you are visiting.

If you are logged into YouTube at the same time, YouTube recognises which specific subpage of our website you are visiting containing a YouTube video. YouTube and Google collect this information and associate it with the individual YouTube account. If you are logged into YouTube when you access our website, YouTube and Google always receive the information via the YouTube components that you have visited our website; this happens regardless of whether you click on a YouTube video or not. ·         in accordance with Art. 17 GDPR, the right to erasure of your personal data we have stored, unless further processing is required

-       for exercising the right of freedom of expression and information;

-       for compliance with a legal obligation;

-       for reasons of public interest or

-       for the establishment, exercise, or defence of legal claims;

·         in accordance with Art. 18 GDPR, the right to demand the restriction of the processing of your personal data, as far as

-       the accuracy of the personal data is contested by you;

-       the processing is unlawful and you oppose its erasure;

-       we no longer need the personal data, but they are required by you for the establishment, exercise or defence of legal claims or

-       you have objected to processing in accordance with Art. 21 GDPR;

·         in accordance with Art. 20 GDPR, the right to receive your personal data, which you have provided us, in a structured, common, and machine-readable format, or to request the transfer to another responsible party;

Right to object
